建设工期与工程造价的关系

　　摘要：首先，通过分析法律规定和实务操作，本文认为建设工程施工合同是先由承包人“按时保质”完成建设工程，后由发包人“按时足额”支付工程价款的双务合同。

　　其次，本文认为“按时保质”是承包人先履行义务，若承包人不能证明发包人造成工期顺延的，实际工期与约定工期之差的延误工期之责由承包人承担。

　　最后，在提出合同造价和成本造价概念的基础上，本文认为工期对工程造价的影响具体是通过合同造价和成本造价来反映的，并且这种反映基于合同造价确定形式的不同而有所不同。

　　Abstract：Firstly， this article voices that construction project contract are two tasks in contract for completing the construction project as required at the specific time and for quality assurance by contractor. Construction price of such work shall thereafter be paid by developer as required at the specific time and the amount payable in full through analyzing the law and regulations and practical operation.

　　Secondly， being the contractor's obligations， due to completing the construction project as required at the specific time and for quality assurance， the work date of delay which is the difference between actual progress and agreed work-day shall be undertaken by contractor， provided that the contractor fails to demonstrate such the extension of work date caused by developer.

　　In the last， upon the bases of briefly introduce to the contract price and construction cost， this easy hold that the working date impacting on construction cost can be reflected by contract price and construction cost， which is difference from the various determined form of contract cost.
